Terms of Service

These Terms of Service govern access to and use of The Trade Winds Merchant Consortium at https://store.khassid.com (the “Store”), including the purchase and download of digital tabletop roleplaying-game materials.

The Store is owned and operated by Darnell Coates, publishing under the name Aelorian Press.

In these Terms, “we,” “us,” and “our” refer to Darnell Coates, publishing as Aelorian Press.

By accessing the Store, creating an account, downloading free materials, purchasing a product, subscribing to the newsletter, or otherwise using the Store, you agree to these Terms of Service. If you do not agree, do not use the Store.

1. About the Store

The Trade Winds Merchant Consortium is the official digital storefront for Tales of Khassid materials published by Darnell Coates under the publishing name Aelorian Press.

The Store offers digital fantasy tabletop roleplaying-game content, including campaign materials, sourcebooks, adventures, lore, rules resources, player options, and related downloadable materials.

All products currently offered through the Store are digital. The Store does not currently offer physical products or physical shipping under these Terms.

2. Eligibility and Age Requirements

You may use the Store only if you can legally enter into a binding contract under the laws that apply to you.

If you are under the age of majority where you live, you may use the Store only with the involvement and permission of a parent or legal guardian.

A parent or legal guardian who permits a minor to use the Store is responsible for that minor’s use of the Store and compliance with these Terms.

3. Accounts

Some Store features may require you to create an account.

You agree to:

• Provide accurate and current information;
• Keep your login credentials confidential;
• Use only your own account;
• Promptly notify us of suspected unauthorized access; and
• Accept responsibility for activity conducted through your account, except to the extent caused by our breach of applicable law.

We may suspend or close an account if we reasonably believe it has been used fraudulently, unlawfully, abusively, or in violation of these Terms.

You may not create an account using another person’s identity, create accounts to evade a suspension, or use automated methods to create or access accounts without our permission.

4. Free Downloads

We may offer certain digital materials at no charge.

Free products are provided subject to these Terms and any applicable Khassid license.

A free download may still be protected by copyright and other intellectual-property laws.

“Free” means that no purchase price is charged. It does not mean the material is in the public domain or may be redistributed without permission.

We may change, withdraw, replace, or discontinue free materials at any time.

5. Paid Digital Products

5.1 Product Information

We attempt to describe products, prices, file formats, compatibility, and other details accurately.

Minor errors, omissions, or changes may occur. We may correct errors and update product information at any time.

5.2 Orders and Acceptance

Submitting an order is an offer to purchase.

An order is not accepted until we confirm it or provide access to the purchased product.

We may decline or cancel an order where permitted by law, including in cases involving suspected fraud, pricing errors, technical problems, duplicate transactions, or violations of these Terms.

5.3 Prices and Taxes

Prices are displayed in the currency shown at checkout.

Applicable sales taxes or other transaction-related charges may be added where required.

Prices may change, but a price change will not alter the price of an order already accepted unless required by law or agreed with you.

5.4 Payment Processing

Payments may be processed by third-party payment providers.

We do not receive or store complete payment-card numbers through the Store unless expressly stated otherwise.

You authorize the applicable payment provider to charge the selected payment method for accepted purchases and any applicable taxes or transaction charges.

6. Digital Delivery and Access

After a successful purchase, the Store may provide access through your customer account, a download page, email, or another digital-delivery method displayed during checkout.

You are responsible for maintaining a compatible device, software, internet connection, and sufficient storage to download and use purchased materials.

We are not responsible for a failure to download caused by your device, software, network, email service, storage limitations, or account settings.

If you experience a reasonable technical problem accessing a purchased product, contact support@khassid.com with your order information.

We will make reasonable efforts to restore access or provide a working copy when appropriate.

You may not share, sell, publish, mirror, scrape, or distribute private download links or customer-account access.

7. Refunds and Cancellations

Because Store products are digital goods that may be accessed or downloaded immediately, purchases are generally non-refundable after access or download, except where required by applicable law or where we determine that a refund is appropriate.

If a purchased file is materially defective, corrupted, inaccessible, or materially different from its description, contact us within 7 days of purchase at support@khassid.com.

Include your order number and a description of the problem.

At our discretion, and subject to applicable law, we may:

• Provide a replacement file;
• Restore download access;
• Provide a corrected version;
• Offer store credit; or
• Issue a refund.

If a duplicate charge or unauthorized transaction appears on your account, notify us promptly so that we can investigate.

We may request information reasonably necessary to verify the transaction.

Nothing in this section limits any non-waivable consumer rights that apply to you.

8. Personal-Use License

Subject to these Terms and, where applicable, successful payment, you receive a limited, non-exclusive, non-transferable, revocable license to access and use purchased and free digital materials.

Unless otherwise stated in a product-specific license or the KARL — Khassid Authorized Role-Playing License, you may:

• Download and store a reasonable number of copies for your personal use;
• Print copies for your personal use;
• Use the materials during private tabletop roleplaying games;
• Display or read the materials during your own gaming sessions; and
• Share reasonable game-related excerpts, handouts, notes, or reference materials within a closed private gaming group.

Unless expressly permitted under the KARL or by separate written permission, you may not:

• Resell, sublicense, rent, lease, or commercially redistribute the materials;
• Upload or distribute the materials, or substantial portions of them, to a website, file-sharing service, social-media platform, repository, or other public location;
• Remove copyright notices, trademarks, credits, watermarks, or other rights notices;
• Copy or adapt the materials to create a competing product;
• Use the materials to train, develop, or fine-tune a machine-learning or artificial-intelligence model;
• Sell reproductions, translations, compilations, derivative supplements, or other products based substantially on Khassid Content; or
• Make purchased materials available to people who have not separately obtained lawful access except as expressly permitted by these Terms or the KARL.

8.1 Public Play, Streaming, and the KARL

The KARL — Khassid Authorized Role-Playing License governs certain permitted uses of Khassid Content in tabletop play, livestreams, podcasts, play-by-post games, character creation, personal campaign writing, and related activities.

Where the KARL grants broader permission than these Terms for a use within its scope, the KARL controls.

Under the KARL, you may:

• Play: Use Khassid Content in private games, campaigns, home tables, livestreams, or play-by-post formats.
• Stream: Broadcast Khassid-based gameplay on platforms such as Twitch, YouTube, or podcasts, provided proper attribution is given.
• Create Characters: Use Khassid species, subclasses, and lore for player characters and NPCs.
• Write for Personal Use: Create adventures or campaign material for private use within Khassid.
• Share Privately: Distribute handouts, notes, or materials within a closed group, provided no monetization or public distribution occurs.

8.2 Streaming and Monetization

You may monetize permitted streams through advertising, subscriptions, donations, sponsorships, or comparable platform features provided that:

• Khassid Content itself is not sold or placed behind a paywall; and
• No unauthorized Khassid-based product is being sold.

You may not sell:

• Access to Khassid-exclusive campaigns as a Khassid product;
• Unauthorized Khassid-based modules or supplements; or
• Khassid-derived books, systems, expansions, or comparable commercial products.

Darnell Coates, publishing as Aelorian Press, reserves the right to revoke permissions granted under the KARL in cases involving misuse, misrepresentation, infringement, or exploitation, subject to the terms of that license.

Official Khassid logos, artwork, or trade dress may appear incidentally during permitted gameplay or streaming but may not be used as standalone branding or in a manner that suggests sponsorship, endorsement, or official affiliation without written permission.

Nothing in this section grants permission beyond the scope of the KARL itself.

9. Intellectual Property and Creative Production

The Store and Tales of Khassid materials may include original text, game design, rules content, fictional settings, characters, stories, maps, layouts, graphic design, branding, editing, compilation, arrangement, illustrations, and other creative elements.

These elements are owned by Darnell Coates, publishing as Aelorian Press, licensed from third parties, or otherwise used as permitted by law, unless a product or page states otherwise.

These Terms grant limited permissions only. They do not transfer ownership.

9.1 Generative Artificial Intelligence Disclosure

Some artwork, illustrations, decorative imagery, character imagery, environmental art, promotional graphics, and other visual materials appearing in Tales of Khassid products, marketing materials, or the Store are created using generative artificial intelligence tools.

AI-generated or AI-assisted visual material may also be:

• Directed through human prompting and art direction;
• Selected from multiple generations;
• Edited;
• Cropped;
• Composited;
• Retouched;
• Color-adjusted;
• Reworked;
• Combined with typography, maps, graphic design, or other material; or
• Incorporated into a larger original layout or publication.

We do not represent AI-generated or AI-assisted artwork as hand-drawn, hand-painted, or otherwise created entirely by a human illustrator.

Where artwork or other creative material is produced by a human artist, commissioned from a third party, or used under a separate license, appropriate credit or licensing information may be provided where applicable.

The use of generative AI in visual production does not alter the restrictions in these Terms regarding unauthorized copying, redistribution, resale, or commercial exploitation of complete Khassid products, layouts, branding, text, or other protected elements.

9.2 Names and Branding

The Trade Winds Merchant Consortium, Tales of Khassid, Khassid, Aelorian Press, and related names, logos, and branding may be protected trademarks, trade names, or other intellectual property.

You may not use them in a manner that suggests sponsorship, endorsement, partnership, ownership, or official affiliation without permission.

If you believe material on the Store infringes your copyright or other rights, contact support@khassid.com with sufficient information for us to evaluate the claim.

10. User Conduct

You may not use the Store to:

• Violate any applicable law or regulation;
• Commit fraud, impersonation, harassment, abuse, or unauthorized access;
• Interfere with the Store’s operation or security;
• Introduce malware, malicious code, or harmful content;
• Scrape, crawl, copy, or systematically extract Store content without written permission;
• Circumvent download limits, access controls, payment controls, or technical protections;
• Upload or distribute content that infringes another person’s rights; or
• Use the Store in a manner that could reasonably damage the Store, its users, Darnell Coates, Aelorian Press, or Tales of Khassid.

11. Newsletter and Electronic Communications

If you subscribe to the newsletter, you consent to receive marketing and promotional emails from us.

You may unsubscribe at any time using the unsubscribe link provided in an email or by contacting support@khassid.com.

We may still send transactional or service-related communications where permitted by law, including:

• Order confirmations;
• Download information;
• Account notices;
• Security messages;
• Service updates; and
• Changes to these Terms or other Store policies.

Our collection and use of personal information are described in the Store’s Privacy Policy.

12. Third-Party Services and Links

The Store may rely on third-party services for functions including payment processing, hosting, email delivery, analytics, authentication, downloads, or related operations.

Third-party services may maintain their own terms and privacy policies.

The Store may also contain links to third-party websites.

We are not responsible for the content, availability, security, or practices of third-party websites or services.

13. Availability and Changes to the Store

We may modify, suspend, replace, or discontinue all or part of the Store, including products, features, download methods, account features, or newsletter services.

We are not required to maintain a particular product, file, feature, or level of availability indefinitely.

Digital products may be updated from time to time.

Unless expressly promised otherwise, we do not guarantee continuing access to every historical version of a product.

14. Disclaimers

To the fullest extent permitted by applicable law, the Store and its content are provided on an “as is” and “as available” basis.

We disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free availability.

We do not guarantee that:

• The Store will always be available or secure;
• Products will be compatible with every device, application, virtual tabletop, printer, or operating system;
• Digital files will remain available indefinitely;
• The Store or its content will be free from errors or harmful components; or
• Products will meet every customer’s particular gaming, creative, commercial, or entertainment requirements.

Some jurisdictions do not permit certain warranty disclaimers, so some of these limitations may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Darnell Coates, publishing as Aelorian Press, will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunities, or anticipated savings arising from or related to the Store, products, downloads, accounts, or these Terms, even if advised that such damages were possible.

To the fullest extent permitted by applicable law, our total liability for all claims arising out of or relating to the Store, a product, or these Terms will not exceed the greater of:

1. The amount you paid for the specific product or transaction giving rise to the claim during the twelve months before the event giving rise to liability; or
2. US $100.

This limitation does not apply to liability that cannot legally be limited or excluded, including liability for fraud, intentional misconduct, or other liability that applicable law makes non-waivable.

16. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Darnell Coates, publishing as Aelorian Press, and his contractors, service providers, agents, and licensors from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to:

• Your breach of these Terms;
• Your unlawful or unauthorized use of the Store or products;
• Your infringement or violation of another person’s rights; or
• Your misuse of an account or download access.

We reserve the right to assume exclusive control of the defense of a claim subject to indemnification, and you agree to cooperate reasonably with that defense.

17. Suspension and Termination

You may stop using the Store at any time.

We may suspend or terminate access to an account or the Store if we reasonably believe that you:

• Violated these Terms;
• Engaged in fraud or abuse;
• Created a security risk; or
• Used the Store unlawfully.

Termination does not erase obligations that by their nature should continue, including intellectual-property restrictions, payment obligations, disclaimers, liability limitations, indemnification, and dispute provisions.

If your access is terminated because of your violation of these Terms, you may not create another account or reacquire access to evade the termination without written permission.

18. Governing Law and Disputes

These Terms and any dispute arising from or relating to the Store or these Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles.

Before filing a legal action, the parties agree to attempt in good faith to resolve the dispute informally.

The receiving party will have 30 days to respond or attempt resolution.

If a dispute cannot be resolved informally, any permitted court proceeding must be brought in an appropriate state or federal court having jurisdiction in Baltimore City, Maryland, except where applicable law requires a different forum or prohibits this agreement.

Each party consents to the jurisdiction and venue of those courts to the extent permitted by law.

Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief when reasonably necessary to protect intellectual-property rights, confidential information, account security, or other rights that may be harmed by delay.

19. Changes to These Terms

We may update these Terms from time to time.

The updated version will be posted on the Store with a revised “Last updated” date.

Changes apply prospectively unless applicable law requires otherwise.

If a change materially affects your rights or obligations, we may provide additional notice where appropriate.

Your continued use of the Store after the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.

20. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

21. No Waiver

Our failure to enforce a provision of these Terms is not a waiver of our right to enforce it later.

22. Entire Agreement

These Terms, together with the Store’s Privacy Policy, the KARL — Khassid Authorized Role-Playing License where applicable, and any product-specific license terms or written agreements, form the entire agreement between you and us regarding your use of the Store unless a later written agreement supersedes them.

23. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Darnell Coates may assign applicable rights or obligations under these Terms in connection with the formation or transfer of a business entity, merger, reorganization, transfer of the business, sale of assets, or similar transaction, subject to applicable law.
